General Terms of Use and Contracting

1. OWNERSHIP

In compliance with Article 10 of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce, the following general information about the Website is provided:

The owner of the website is Masia Vallformosa S.L. (hereinafter, “VALLFORMOSA”), with registered address at C/ Camí de la Sala, s/n, 08735 Vilobí del Penedès, Barcelona, Spain, and Tax ID (NIF): B08656688.

2. PURPOSE

2.1

VALLFORMOSA provides, through its websites, app, or any other current or future platform (hereinafter, the “WEBSITE”), a technological platform where wines, sparkling wines, and any other products or services are offered for remote purchase by users (hereinafter, “USERS” or “CUSTOMERS”).

2.2

VALLFORMOSA may expand or modify the WEBSITE at any time, depending on the development and evolution of its products and services, including adding, replacing, or updating products, services, activities, or content.

3. TERMS OF USE

3.1 Acceptance of Terms of Use and Contracting

3.1.1

These General Terms of Use and Contracting (hereinafter, the “General Terms”), together with the Privacy Policy, govern access to and use of the WEBSITE by USERS, as well as the purchase of products and services through it.

3.1.2

The USER must carefully read these General Terms each time they access the Website, as they may be subject to changes. The USER declares that:

  • They have read, understood, and accepted these terms;
  • They are of legal age and have sufficient legal capacity to purchase alcoholic beverages according to the laws of their country of residence;
  • They accept all obligations set out herein;
  • They understand that the WEBSITE is a technological platform owned by VALLFORMOSA from which products may be purchased.

3.1.3

The owner of the WEBSITE reserves the right to modify or update, at any time and without prior notice, its content and services, these General Terms, and any elements of the Website’s design and configuration.

3.2 Access to the WEBSITE and Legal Age

3.2.1

Access to the WEBSITE is free, except for the cost of internet connection provided by the USER’s telecommunications provider.

3.2.2

Given that the WEBSITE includes alcoholic products, access is restricted to persons of legal drinking age according to the laws of their place of residence. If you are a minor, please leave the Website immediately.

3.3 Registration Requirement

3.3.1

In general, registration is not required to access the WEBSITE. However, some services or content may require prior registration.

3.3.2

The USER must ensure that all data provided is accurate, current, and truthful. Registered USERS are responsible for safeguarding their password and any damages arising from misuse, disclosure, or loss. Any activity carried out under a USER’s credentials shall be deemed to have been performed by that USER.

3.3.3

By registering, you become a user, client, or commercial contact of VALLFORMOSA. As indicated in our Privacy Policy, communications may be sent under legitimate interest pursuant to European data protection regulations and applicable e-commerce law. Each communication will include the option to exercise your rights.

3.4 Rules of Use

3.4.1

The USER undertakes to use the WEBSITE and its content in compliance with the law, public order, morality, and these General Terms.

3.4.2

The USER agrees not to use the WEBSITE for unlawful activities or actions that infringe third-party rights, including intellectual and industrial property rights.

3.4.3

The USER agrees not to transmit or distribute any content that is illegal, harmful, or contrary to these Terms. This includes, but is not limited to:

  • Racist, xenophobic, pornographic content or content promoting terrorism or irresponsible alcohol consumption
  • Malware or harmful software
  • False, misleading, or inaccurate information
  • Unauthorized advertising or spam
  • Identity theft or misuse of credentials
  • Violations of intellectual or industrial property rights
  • Violations of privacy or data protection laws

The USER shall indemnify VALLFORMOSA against any claims, penalties, or damages arising from non-compliance with these obligations.

3.5 Disclaimer of Liability

3.5.1

VALLFORMOSA is not obliged to monitor the absence of viruses or other harmful elements. USERS must ensure they have appropriate protection tools.

3.5.2

VALLFORMOSA shall not be liable for damage to users’ systems resulting from use of the WEBSITE.

3.5.3

VALLFORMOSA shall not be liable for service interruptions caused by telecom network failures.

3.6 Linked Content and Services

3.6.1

The WEBSITE may include links to third-party websites (“Linked Sites”). VALLFORMOSA is only responsible for such content if it has actual knowledge of illegality and fails to act.

3.6.2

The existence of links does not imply any relationship, endorsement, or recommendation.

3.6.3

VALLFORMOSA does not control Linked Sites and is not responsible for their content or services.

3.6.4

Where USERS purchase products or services via Linked Sites, VALLFORMOSA acts solely as an intermediary and is not liable for any issues arising from these transactions.

4. PURCHASE CONDITIONS

4.1 Order Process

To purchase products through the WEBSITE:

  1. Click the “Buy” button next to the product
  2. Select quantities and enter shipping details
  3. Proceed to “Place order”

Discount coupons must be entered during checkout. If not applied, they cannot be claimed afterward.

The USER will then:

  • See delivery details and costs
  • Choose a payment method
  • Click “Secure payment” and receive confirmation

The USER is responsible for accurate delivery data.

Bank transfer orders are only valid for 48 hours and subject to availability.

Resale is not authorized.

5. PRICE AND PAYMENT

5.1 – 5.3 Pricing

  • Prices are indicated by VALLFORMOSA
  • Prices are in euros or local currency
  • Obvious pricing errors (≥50% deviation) may lead to order cancellation

5.4 Payment

  • Secure payment methods are provided
  • Third-party payment providers may be used
  • VALLFORMOSA does not store banking details
  • Orders may be cancelled in case of errors or suspected fraud
  • Identity verification may be requested

Bank transfer orders will be processed once payment is received.

PayPal agreements may be cancelled via the user’s account.

Import duties and taxes are the USER’s responsibility.

5.5 Shipping and Delivery

  • Shipping costs are generally borne by the USER
  • Costs are shown during checkout
  • Orders are processed within 48 working hours

The USER must check the order upon delivery and report issues immediately. Failure to notify issues at delivery may invalidate claims.

Deliveries are made to the address provided. VALLFORMOSA is not liable for failed deliveries due to incorrect details or recipient absence.

Delivery will occur within a maximum of 30 calendar days.

Deliveries are made on working days (Monday to Friday, 9:00–19:00). Weekend or holiday deliveries are not available.
